Website Terms

Effective date: 2026-10-12

Scope and agreement

These Website Terms concern the seller website at sell.gorgelandco.com, operated by Gorge Land Company, LLC (Gorge, we, us), and inquiries submitted through it. When a form prominently states that submission means agreement to these Website Terms, selecting its Request an offer or Respond to mail button indicates that agreement. Browsing the site or giving property-email permission alone does not indicate agreement to these terms or to a property purchase.

Our role

Gorge considers buying land as a principal for its own account. We do not act as the seller's agent or represent the seller's interests. Our model is to purchase the property ourselves, not assign our purchase contract to another buyer. We may resell property after acquiring it.

Website information is general information about our business and inquiry process, not an appraisal or legal, tax, investment or other professional advice. You may consult your own advisers before deciding to sell or accept an offer.

Inquiries, offers and agreements

Submitting an inquiry does not require either party to enter a transaction or guarantee an offer. A receipt confirms intake, not verified ownership, an offer, acceptance, separate message delivery or a response time. A flyer or invitation is not necessarily an offer.

Any offer is governed by the property, price, conditions, acceptance requirements and any expiration expressly stated in that offer. These Website Terms do not create or extend an offer deadline or amend an existing offer or property agreement.

The original offer and its status must be checked. A mail reference, request for a different price or inquiry confirmation does not change an offer. An executed property agreement and its valid amendments govern the transaction, including price, funding, deposits, title, escrow, expenses, contingencies, closing, remedies and notices. These Website Terms do not replace or waive those documents. Electronic records and signatures may have legal effect in the applicable agreement process; this inquiry form is not that process.

Information and authority

Provide information accurate to the best of your knowledge and identify material corrections. Submit another person's information or act for another owner only with authority. A parcel number or mail reference does not establish identity, ownership or permission to disclose private records.

Do not submit sensitive identity documents, passwords, financial credentials or unrelated personal information. Do not impersonate someone, send unlawful content, disrupt the site or seek unauthorized access.

An inquiry transfers no interest in land, appoints no agent, grants no power of attorney and does not authorize Gorge to market property before owning it.

Contact permission and privacy

Property-email permission is requested separately. It does not authorize unrelated marketing, telephone calls, text messages, recording or automated voice communications. The Privacy Policy explains information handling; reading it is not marketing consent. Agreement to these Website Terms does not expand the contact permission you provide.

SMS Program

Gorge Land Company offers voluntary SMS/MMS customer-care messages about property inquiries. By texting LAND to (541) 827-3110, you agree to receive SMS messages from Gorge Land Company about your property inquiry. Message frequency varies. Message and data rates may apply.

Reply STOP to opt out. Reply HELP for help, or email support@gorgelandco.com for alternate support. You may opt back in by texting START. Carriers are not liable for delayed or undelivered messages.

SMS participation is voluntary and is not a condition of selling property or using the website. Receipt of direct mail alone is not SMS consent. Website-form submission, a known telephone number or a parcel reference also does not enroll you. Consent occurs when you voluntarily text the opt-in keyword.

The Privacy Policy describes how we handle mobile numbers, messages, MMS files, and consent and opt-out evidence. These customer-care messages do not authorize unrelated marketing or change an offer or property agreement.

Content and website availability

The landscape photograph is illustrative, not a Gorge property. Property-specific statements must be assessed against the relevant records and transaction documents. Branding, original content and credited third-party materials remain subject to their respective rights; these terms do not claim ownership of public-domain material or restrict uses permitted by law.

Subject to the exceptions below and to the extent permitted by law, the website and its general informational and inquiry functions are provided as is and as available, without implied warranties as to those website functions. We do not warrant uninterrupted or error-free availability. If submission is not confirmed, follow the displayed retry instructions; do not assume an offer or agreement was delivered through this form.

Limited website consequential-damage exclusion

Subject to the exceptions below and to the extent permitted by law, Gorge is not liable for consequential damages arising solely from use of, or inability to use, this website. This provision sets no monetary liability cap and does not exclude direct damages otherwise recoverable under applicable law.

The website warranty limitations and consequential-damage exclusion do not limit nonwaivable rights or remedies, responsibility for fraud, gross negligence or willful misconduct, applicable privacy or data-security obligations, or rights and obligations under an issued offer or separate property agreement. They do not govern a land transaction or displace its agreed remedies.

Governing law and severability

Oregon law governs these Website Terms, subject to applicable federal law and any mandatory protections or rules requiring another jurisdiction's law. This clause does not change the law governing property, an issued offer or a separate agreement, and selects no mandatory court or forum.

If a provision is held unenforceable, it is severed only to the extent necessary, and the remaining provisions continue to the extent permitted by law. Severability does not expand the warranty limitations or damages exclusion beyond their express exceptions.

Changes and transaction notices

Revised Website Terms will be posted with their effective date and apply prospectively when presented and accepted through the applicable submission process. A revision does not rewrite an earlier submission's accepted terms or an existing transaction document.

For questions about these Website Terms, email support@gorgelandco.com.

For formal notice under an offer or agreement, follow that document's notice provisions. A website inquiry does not replace a specified contractual notice or service-of-process method.

October 7, 2026 update: added the voluntary SMS Program and its support and opt-out terms.
